1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of Birdieres's ("we," "us," or "Birdieres") platform ("Platform"), including all services related to our badminton court booking, social networking, and event management services. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

2. Service Description

Birdieres provides a comprehensive platform for badminton enthusiasts to book courts, organize games, and connect with other players, including but not limited to:

Real-time court availability and booking at multiple locations
Multi-court reservations for group play
Friends list and group management features
Event creation with customizable visibility settings
Waitlist management for popular time slots
Calendar view with filtering by location, friends, and dates
Mobile-optimized interface for on-the-go booking

We facilitate connections between badminton players and court facilities, making it easier to organize games, find playing partners, and manage bookings efficiently.

3. Account Creation and Eligibility

User Accounts: To use our services, you must create an account by providing accurate and complete information as requested in our registration process.
Account login is authenticated via your email and password or through supported third-party providers.
Groups and Clubs: Badminton clubs, playing groups, and recreational organizations may create group accounts with designated administrators who can manage members and organize group bookings.

By creating an account, you represent that you are at least 18 years old and capable of entering into a legally binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of the Platform

Authorized Use: You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not use the Platform in any way that violates applicable laws or regulations.
Jurisdictional Use: The Platform is intended for users booking courts at participating facilities. Court availability depends on partnerships with individual venues. Birdieres reserves the right to restrict access to the Platform at any time and in any jurisdiction.
License to Use the Platform: Birdieres grants you a limited, non-exclusive, non-transferable, and revocable license to use the Platform in compliance with these Terms.
Prohibited Activities: You agree not to engage in any activities that may interfere with the proper operation of the Platform, circumvent any security measures, or infringe upon the rights of other users.

5. Court Bookings and Fees

Court Bookings: When you book a court through our Platform, you are authorizing Birdieres to reserve the court on your behalf with the facility. You are responsible for adhering to the facility's rules and regulations during your booking.
Fees and Charges: The fees for court bookings are clearly displayed before you confirm your reservation. These fees may include court rental fees, service fees, and any applicable taxes. Additional fees may apply for equipment rental, coaching services, or premium time slots.
Payment Terms: Payment is required at the time of booking unless you have booking credits or a subscription. We accept major credit cards and other payment methods as indicated on our Platform. Subscription plans and credit packages may be available for frequent players.
Group Accounts: Badminton clubs, playing groups, and recreational organizations may establish group accounts with multiple members. 6. Booking Confirmations and Cancellations

Court bookings are confirmed immediately upon successful payment. You will receive a confirmation email with booking details and any facility-specific instructions. Cancellation policies vary by facility and are displayed before booking confirmation. Some facilities may offer partial refunds or credits for cancellations made within specified timeframes, while others may have no-refund policies for last-minute cancellations.

7. Refund Policy

Refund policies are determined by individual court facilities and are displayed during the booking process. Generally, we may provide refunds in the following circumstances:

If a court becomes unavailable due to facility closure or maintenance (full refund or credit)
If you cancel within the facility's specified cancellation window (partial refund or credit may apply)
If there was a technical error resulting in duplicate bookings or charges

8. Facility Information and Court Conditions

Birdieres displays court availability and facility information as provided by our partner venues. While we strive to maintain accurate and up-to-date information, actual court conditions, amenities, and availability may vary. Users should verify specific requirements or conditions directly with facilities when necessary. We are not responsible for court conditions, equipment availability, or facility policies beyond what is displayed on our Platform.

9. Intellectual Property

Platform Intellectual Property: All rights, title, and interest in the Platform and its underlying technology, trademarks, copyrights, and other intellectual property are owned or licensed by Birdieres. Unauthorized use of Birdieres's intellectual property is strictly prohibited.

User Content: You retain ownership of any content you post on the Platform (such as player profiles, group descriptions, or event details). By posting content, you grant Birdieres a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the Platform.

10. Privacy and Data Use

We collect and process personal information as described in our Privacy Policy. By using our Platform, you consent to our data practices as described in that policy. We use booking and player information you provide to facilitate court reservations, connect you with other players, and improve our services.

11. Limitation of Liability

To the maximum extent permitted by law, Birdieres shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of the Platform or court bookings made through it, even if Birdieres has been advised of the possibility of such damages. Our aggregate liability for any claims related to the Platform or services shall not exceed the amount you paid for the specific booking giving rise to the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising out of these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Modifications to Terms

We may modify these Terms at any time by posting the revised terms on our Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes through email or notices on our Platform.
